President Biden named Christopher Hanson NRC Chairman this morning. Hanson replaces Kristine Svinicki, who departed the agency on Jan. 20, 2021, after serving as Chairman since 2017.

DOE Reorganization Announced
ECA Staff | 1/13/2021
The first reorganization in the Biden Administration of DOE is now announced. The new org chart is below.
A couple of notes: EM now reports to the Secretary’s office (instead of the Undersecretary for Science). The new Undersecretary for Science and Energy oversees NE and other energy programs. This brings all of the energy programs under one Undersecretary.
Also, the new Secretary-designate has her confirmation hearing on Wednesday (January 27). The earliest she would start is in the beginning of February.
No nominees have been named publicly for NNSA, EM, NE or the Undersecretaries. ECA will keep you posted on the progress. For more information on ECA transition priorities, please see our transition paper here.

Below is the message from the new DOE Chief of Staff on the changes:
"I have heard from so many of you in these past few days. Thank you for your warm welcome. I am looking forward to working with all of you, listening to your ideas and experiences, learning from your insights, and accomplishing the mission of The Department of Energy (DOE). President Biden has charged his appointees at DOE to forge new partnerships with the career civil service so that we may all bring relief to the American people amid the current crises and ensure our Nation builds back better. The President has recorded a brief video message to share his values and his commitment to you in his own words.
I also want to share with you an update on the new DOE organizational structure and those who have been appointed by the President to lead several DOE organizations. We have taken an immediate step to update the Department’s organizational structure so that the applied energy programs report to the same Under Secretary as the Office of Science. This Under Secretary portfolio has been renamed to the Office of the Under Secretary for Science and Energy. Once we have a confirmed Secretary of Energy, DOE’s organizational structure will be further reviewed and potentially modified. The new DOE organizational chart is attached.
Office of the Secretary and Direct Reports – As announced on Wednesday, Dave Huizenga is the acting Secretary of Energy. Christopher Davis is the Special Assistant to the Secretary and Caroline Grey is the new White House Liaison. The new Director of the Office of Public Affairs is David Mayorga.
There are many offices that report directly to the Office of the Secretary, which now include the Office of Environmental Management (EM) and the Office of Legacy Management (LM). Below is the list of individuals who were appointed to principal deputy positions or were designated by the President to serve in acting roles reporting directly to the Office of the Secretary:
Chief Financial Officer (CF): Chris Johns
Congressional and Intergovernmental Affairs (CI): Ali Nouri, Principal Deputy Assistant Secretary
Environmental Management (EM): Ike White
International Affairs (IA): Andrew Light, Principal Deputy Assistant Secretary
Office of the Under Secretary – This new Under Secretary portfolio has two offices, Environment, Health, Safety, and Security (AU) and Project Management Oversight and Assessments (PM), who continue to be led by its career Directors.
Office of the Under Secretary for Science and Energy – This new Under Secretary portfolio now has responsibility for overall stewardship of the basic science and energy programs, their budgets, the laboratories associated with these programs, and crosscutting energy research. Under this arrangement, DOE will be better able to coordinate its RD&D programs in response to the climate crisis.
The new Director of the Office of Technology Transitions (OTT) is Vanessa Chan. She is also the Department’s new Chief Commercialization Officer. Below is the list of individuals who were appointed to principal deputy positions or were designated by the President to serve in acting roles reporting directly to the Under Secretary for Science and Energy:
Cybersecurity, Energy Security and Emergency Response (CESER): Pat Hoffman
Energy Efficiency and Renewable Energy (EERE): Kelly Speakes-Backman, Principal Deputy Assistant Secretary
Fossil Energy (FE): Jennifer Wilcox, Principal Deputy Assistant Secretary
Nuclear Energy (NE): Dennis Miotla
Office of the Under Secretary for Nuclear Security – We are pleased to announce Dr. Charles Verdon has agreed to remain the Deputy Administrator for Defense Programs (NA-10) and has been designated by the President to act as the Under Secretary for Nuclear Security and the Administrator for the National Nuclear Security Administration. Catherine Mendelsohn is the acting Deputy Administrator for Defense Nuclear Nonproliferation."

NNSA to hold two virtual public scoping meetings regarding an Environmental Impact Statement for the Surplus Plutonium Disposition Program

The Department of Energy’s National Nuclear Security Administration (DOE/NNSA) will hold two virtual public scoping meetings on a new Environmental Impact Statement for the Surplus Plutonium Disposition Program. The meetings will be held on Monday, Jan. 25 from 5 to 9 p.m. Eastern Time and Tuesday, Jan. 26 from 7 to 11 p.m. Eastern Time. Participants can join by computer, telephone, or other device.
The Surplus Plutonium Disposition Program (SPDP) EIS will analyze alternatives for the disposition of 34 metric tons of surplus plutonium using the capabilities at multiple sites across the Nation. NNSA’s preferred alternative, the dilute and dispose approach, is also known as “plutonium downblending,” and includes converting pit and non-pit plutonium to oxide, blending the oxidized plutonium with an adulterant, and emplacing the resulting transuranic waste underground in the Waste Isolation Pilot Plant (WIPP). The approach would require new, modified, or existing capabilities at the Savannah River Site in South Carolina, Los Alamos National Laboratory in New Mexico, the Pantex Plant in Texas, and WIPP in New Mexico.
The Notice of Intent contains a full description of the proposal and other options for providing public comment until Feb. 1 (e-mail, phone, regular mail). Following completion of the public scoping comment period, NNSA will prepare a Draft EIS and allow further public comment on that document before preparing a Final EIS and Record of Decision.

Site-by-site breakdown of funding and policies in the FY 2021 appropriations and defense bill

The Fiscal Year 2021 appropriations and National Defense Authorization Act are now finalized, after Congress passed several funding stopgaps in December. Early this year, Congress overrode a veto of the NDAA to enact the bill.
Overall funding increases
The FY 2021 energy appropriations provide an overall increase in funding for the Department of Energy. DOE will receive $39.6 billion, which is $1 billion above the FY 2020 level. Within DOE:
National Nuclear Security Administration: $19.7 billion, a $3 billion increase
Office of Environmental Management: $7.59 billion, a $131 million increase
Office of Nuclear Energy: $1.5 billion, a $14.2 million increase
Office of Science: $7.026 billion, a $26 million increase
Office of Legacy Management: $163 million, a $1 million increase
Advanced Research Projects Agency—Energy: $427 million, a $2 million increase

Policies in the NDAA
Plutonium pit production
In the FY 2021 NDAA, Congress included a provision that would continue to study the costs of NNSA’s plan for expanded plutonium pit production. Sec. 3114 would require an independent cost estimate for pit production at both the Savannah River Site and at Los Alamos National Laboratory.
Cleanup
The NDAA also contains several provisions related to defense environmental cleanup. Under the new law, the Secretary of Energy will be required to make an annual statement of environmental liabilities for each cleanup facility (Sec. 3121). Future-years defense environmental cleanup plans now must identify missed milestones for each site (Sec. 3122).
Similar to the NDAA last year, there will be another one-year prohibition on DOE’s reclassification of high-level waste in the state of Washington (Sec. 3124). Additionally, the DOE will be required to conduct a study on approaches to treating low-activity waste at the Hanford Nuclear Reservation within two years (Sec. 3125).
Budget request authority for DOE and NNSA
Last year when the House and Senate were developing their versions of the NDAA, ECA wrote about a provision in the Senate bill that would have allowed the Nuclear Weapons Council (NWC) to require the DOE Secretary to increase the NNSA budget, which would likely decrease the EM budget since they are both the large defense budget line items.
However, the final NDAA contained a provision (Sec. 1632) that still provides the DOE Secretary with final authority over requested funding, but if the NWC believes the nuclear weapons budget is inadequate, the Secretary must provide NWC’s recommendations as an attachment to the budget request.
NNSA workforce and contractors
NNSA will be required to provide an annual report on “workforce diversity, equality, and inclusion in the NNSA’s contractor workforce” (Sec. 3146). In the NDAA conference report, conferees noted, “…the modernization of all legs of the nuclear triad will be the largest undertaking asked of the NNSA since the end of the Cold War. The NNSA has demonstrated strong progress towards the hiring and retention of the next generation of nuclear security workers across the enterprise. The conferees believe that continued progress in rebuilding and maintaining a diverse and highly qualified workforce is essential to the national security of the United States.”
Additionally, the NDAA establishes a new requirement for “covered National Nuclear Security Administration contractor and subcontractor networks are successfully penetrated by unauthorized entities” (Sec. 3131).
As Congress, DOE, and NNSA continue to search for ways to improve the nuclear workforce, the NDAA includes some Department of Defense workforce programs that could ultimately serve as useful models for DOE/NNSA. For example, the new law establishes a scholarship pilot program for students at minority institutions; pay increases for national security fellowships; and partnerships between DOD and contractors to promote interest in STEM careers.
Not included in the final defense bill
Just as important as what was included in the NDAA are the provisions that were not included in the conference report. Among the notable provisions excluded from the final bill include:
A prohibition on use of funds for nuclear weapons test explosions;
Authorization of appropriations for W93 nuclear warhead program;
Establishing an advanced manufacturing development program
