Court to Weigh Challenge to Yucca Cancellation

A U.S. federal appeals court is set on Wednesday to consider a bid by two states to force movement on a seemingly dead plan to construct a massive underground nuclear-waste storage facility at Yucca Mountain in Nevada, McClatchy Newspapers reported (see GSN, Jan. 27).
The Nuclear Regulatory Commission has yet to determine if the Obama administration has taken suitable steps to cancel a prior Energy Department request to move forward with the project (see GSN, July 6, 2011). No progress on the plan is possible minus an NRC ruling or action on Capitol Hill.
South Carolina and Washington state are pursuing a lawsuit because the Energy Department had "unilaterally" withdrawn its authorization request, South Carolina Attorney General Alan Wilson said on Monday. "They're not enforcing the law that was passed."
