| It is finally here. After nearly two years, the US Department of Energy (DOE) has issued another notice of proposed revisions to its nuclear technology export control regulations in 10 CFR Part 810. What are the most important changes? What are the changes that DOE is proposing but that are not fully explained in the rulemaking proposal? How might these changes affect you? Join Tamra Domeyer, Associate General Counsel at Exelon Generation, and Alex Polonsky, a Partner in Morgan Lewis’ Energy Practice, as they present an overview of nuclear export controls, discuss the impact of these recently-announced changes on the nuclear sector, and answer your questions during a live webinar. In September 2011, the DOE published proposed changes to Part 810 and requested public comments. These were the first significant proposed changes since 1986. The commercial nuclear power industry and other stakeholders submitted to DOE a significant number of comments, causing the Department to rethink its approach to some aspects of the revised rule. On August 2, 2013, after nearly two years of considering stakeholder comments, the DOE issued a supplemental notice of proposed rulemaking (SNOPR) for Part 810. DOE is once again seeking public comment. Ms. Domeyer and Mr. Polonsky will provide a short overview of nuclear export controls imposed by the DOE, the U.S. Nuclear Regulatory Commission, and the U.S. Department of Commerce. They then will discuss the significant changes in the SNOPR compared to both the current rules and the Sept 2011 proposed changes, and explain how they view the proposed rules’ impact on business in the nuclear sector, both domestic and abroad. |
